for a bay area family is finally coming to an end. a verdict will be announced in the murder trial of sierra lamar's accused killer today. the teen went missing near morgan hill back in 2012... her body has never been found. antolin garcia- torres is charged with her murder. his lawyers claim sierra lamar is not dead, just missing. if convicted, he could face the death penalty. kron four's ella sogomonian spoke with a legal expert who is closely monitoring this case. "obviously the threshold question for this jury that needed to be decided was, 'is it possible that sierra lamar still be alive?'one of many challenges a jury has had to face before making their decision in the kidnapping and murder trial of morgan hill teen sierra lamar. the fifteen year old went missing five years ago as she was walking to a bus stop to get to school. but because her body was never recovered, there wasn't a crime scene and a weapon wasn't found the jury could possibly find defendant antolin garcia torres innocent of murder.steven clark, legal

analyst and former prosecutor "and that could explain why this jury came back quickly if they don't believe the prosecution was able to prove that sierra lamar is dead then they really wouldn't reach a verdict on a homicide." the defense however has pointed to dna evidence found on garcia torres 's property like a rope in his car. "what they were able to show with the forensic evidence and the defendant's own statement is that he had the opportunity to commit this crime and there was never a definite explanation for that dna transfer."and although 11 hours of deliberation may sound like a long time to the average person - the analyst says that is pretty quick for a decision in a trial that started back in january."there was competing evidence on virtually every aspect in the case. from the forensic evidence to the defendant's statements to the issues of sierra lamar being a runaway. i'm surprised the jury was able to condense that and come to a verdict so quickly."

( james ) a violent and high risk predator. that's what police are calling a man they arrested in santa rosa. investigators say daniel lee used an alias to attend santa rosa junior college as a student. the 41-year-old transient was wanted out of southern california where he was on parole and failed to register as a sex offender. police became aware of lee because of reported unusual behavior in one of his classes. he was listed on the megan's law website. he has committed a number of sex crimes including indecent exposure, child molestation and assault

with the intent to commit rape. ( james ) this morning we are hearing from a victim of the bart mob attack last month. rusty stapp and his family are now suing bart for three million dollars. they were returning from a birthday dinner in san francisco when the mob began pounding on the train as it pulled into the coliseum station. stapp and his family claim bart did nothing to prevent the attack and robbery. they say the person driving the train should have realized people were pounding on the doors and never opened them. ( james ) stapp's attorney says bart must answer

for its lack of security at fare gates. bart now has 45 days to respond to the claim. kron four's j-r stone spoke with the acting bart police chief about the attack. acting bart police chief jeffery jennings defending his police department monday saying that bart police officers were working extra hours before the mob attack at the oakland coliseum station and continue to work extra hours.sot this past weekend i don't know if they are juveniles or adults we arrested 16 people with my extra staffing which thwarted a lot of activity.at this point jennings says only one juvenile is still being directly linked to the mob attack. bart doesn't plan on releasing video of the incident. saying it would be against state law. however, former bart police chief gary gee says while that may be correct he's talked with several experts who say they could also use the law to release the video to help identify the suspects.sot what

( james ) happening now. there is a proposal to turn highway- 37 into a toll road. kron four's charles clifford breaks down the potential plan and the reaction from commuters. well, 40 thousands cars use highway 37 every day. it connects marin, sonoma, napa and solano counties. but the traffic backups and frequent

flooding have become a problem here. recent estimates have suggested it could take billions of dollars to fix thos issues. at this point, charging commuters a toll to address those problems is just an idea but one that is being seriously considered.for the past few years, a committee of elected officials from across the north bay has been working on finding ways to reduce congestion on highway 37 and address the flooding problems. under normal circumstances, it could take caltrans years or decades to secure the necessary funding and fix the roadway but the committee says that charging tolls could be a way to speed up the process. maybe getting the work done in less than a decade.sotwe are at the beginning of this processmarin county supervisor damon connolly sits on the committee. he says that so far there are no specifics on how much the tolls would be or how that money would be collected.sotwhat we are seeing is some sort of public private partnership potentially and tolling could be a part of it.monday afternoon, i asked several people in novato what they thought of the idea of paying a toll on 37. amanda drives that way almost every day.

( james ) we are learning how much it is going to cost to fix some of the roads damaged during the winter storms. 37-million dollars is needed to fix highway 35 in santa clara county. highway 35 washed out in the santa cruz mountains in february. cal-trans says it will need to build a retaining wall to get the road repaired and back open. according to caltrans, this road will cost the most to fix than any other road damaged by the winter storms. is dealing with the shock of finding out not áonlyá was her sixth grade daughter attacked at school... but that someone recorded the whole attack then posted it online. she's demanding answers this morning. spencer blake has the story you will only see on kron four. (pkg) (looklive)"at solano middle school, plenty of students have seen the video that somebody uploaded of a sixth grader getting pummeled during p-e."this is that video. it starts with the victim seated in her spot, ready for p-e.if you listen, you can hear taunting from others."she said, 'hello' and i was sittin' there ignoring her and she just started beating on me."the girl came home that day in early march with some knots on her head.someone in the school office called her mother, emma simms.but simms says the administrator only said her daughter was 'upset.' "had i known that my daughter was beat up like that, i would've been here quick and in a hurry."the sixth grader

girl makes his first court appearance. prosecutors say darrel alan harris started sexually assaulting a girl in 2008 and then assaulted her again when she was older. harris was arrested in eureka and brought back to marin county. he is now in jail on 750-thousand dollars bail. harris' attorney and family believe he is innocent.

( will ) jurors in the sierra lamar murder trial have reached a verdict, santa clara county superior court officials announced this

afternoon. the verdict will be read in court at 9 a.m. on tuesday at san jose's santa clara hall of justice. antolin garcia-torres, 26, pleaded not guilty to the murder of 15-year-old sierra, who has not been seen or heard from since march 16, 2012, and to the attempted kidnappings of three women in safeway parking lots in 2009. if garcia-torres is found guilty, the jurors will weigh the aggravating and mitigating factors and select between death and life without the possibility of parole. both sides would be allowed to present evidence during this phase of the trial.

garcia-torres was arrested on may 21, 2012, two months after sierra went missing and after investigators found his dna on her jeans, which were recovered near where she went missing outside morgan hill. sierra's dna was also found on an interior backseat door handle and on the outside of a pair of work gloves in garcia-torres' 1998 red volkswagen jetta. defense attorneys for garcia-torres have alleged cross- contamination during the evidence collection process, pointing to sloppy techniques by the santa clara county district attorney's crime laboratory. ( james ) in the east bay. we are learning more about the murder of a castro valley woman who was found dead inside her home. the alameda county sheriff's office say this man... luckie dacaney ((dack- uh-knee)) recently confessed to the brutal murder of andrea st. john police found the 59-year-old's burned body inside her castro valley home on grove back in december. investigators say in addition to confessing to killing andrea saint john, video evidence also helped confirm the suspect's identity. ( james ) members of the "assyrian church of the east" in san jose say they are scared after someone deliberately started a fire at the church. the fire happened early sunday morning. while there was no threat against the church, federal investigators were called out because the fire was at a place of worship. those who work at this church fear the person who started the fire will return and do more damage. no one was injured in the fire. ( james ) the parents of a man who was murdered nearly 13 years ago, along with his fancee, got their first step towards closure. jason allen and lindsay cutshall were murdered on a beach in jenner in 2004. for years, there were no leads in the cold case investigation. but last week, the sonoma county sheriff's office made an announcement... the killer was in custody last week. lynsey mukomel sat down with jason's parents. the sonoma county sheriff's department has a suspect in custody for the double murder on a jenner beach that happened more than a decade ago.lindsay cutshall and jason allen were shot in killed in their sleeping bags while camping on fish head beach in august 2004.shaun gallon, 38, has been identified as the suspect. he was in custody for the murder of his brother when

deputies questioned him on the jenner murders.authorities say gallon had information on the killings that no other person could have known. they also said they have gathered evidence linking gallon to the crime.investigators believe the murders were random and that gallon did not have any connection to the couple. gallon was arrested on march 25 for the murder of his brother in forestville.no one has ever been charged in the killings, and no motive has ever been made public. the sonoma county sheriff's dispatchers said they had no more immediate information friday morning.

( james ) that was lynsey mukomel reporting. the suspect in the case was already in custoy, accused of killing his brother. police say they used that opportunity to talk to him again about the killing of the couple. ( james ) national headlines. a video has gone viral...showing a 68-year-old woman pummeled as she tries to get a group of kids to turn down the music at a pool party. this was near fort lauderdale, florida over the weekend and now the sheriff's department is involved. police say she was walking her dogs then went to her apartment complex pool to tell the group of kids to quiet down. the 16 year old who lifted the woman up was trying to throw her in the pool but slipped instead, allowing her to slam against the concrete. he then dragged the 68 year old lady into the pool as he too goes in.

( james ) opponents of california's bullet train are trying to put the brakes on one of the governor's big projects. judge raymond cadei (kah-day) rejected opponents' latest lawsuit. it was aimed at blocking the state's 64-billion dollar high- speed rail project. opponents are now being advised to challenge yesterday's ruling by the sacramento county superior court judge. judge cadei (kah-day) is allowing them to refile a lawsuit but they must present different arguments ( james ) coming up in a few minutes on the kron four morning news at five. warriors take out the brooms once more.. and sweep the utah jazz. reaction from the dubs dominating game 4 victory. and after the break. heroics in one game, heartbreak in the other.

reached a verdict, santa clara county superior court officials announced this afternoon. the verdict will be read in court at 9 a.m. on tuesday at san jose's santa clara hall of justice. antolin garcia-torres, 26, pleaded not guilty to the murder of 15-year-old sierra, who has not been seen or heard from since march 16, 2012, and to the attempted kidnappings of three women in safeway parking lots in 2009. if garcia-torres is found guilty, the jurors will weigh the aggravating and mitigating factors and select between death and life without the possibility of parole. both sides would be allowed to present evidence during this phase of the trial. garcia-torres was arrested on may 21, 2012, two months after sierra went missing and after investigators found his dna on her jeans, which were recovered near where she went missing outside morgan hill. sierra's dna was also found on an interior backseat door handle and on the outside of a

( darya ) this morning we are hearing from a victim of the bart mob attack last month. rusty stapp and his family are now suing bart for three million dollars. they were returning from a birthday dinner in san francisco when the mob began pounding on the train as it pulled into the coliseum station. stapp and his family claim bart did nothing to prevent the attack and robbery. they say the person driving the train should have realized people were pounding on the doors and never opened them.

( mark ) police have identified the man who shot at officers over the weekend in san jose. he is 29-year-old kevin riley. police say riley started firing at them sunday morning on tully road. police shot back, but did not hit him. riley was later arrested at a mobile home park in the area. this was the third officer involved shooting in the last week. ( darya ) the golden state warriors are heading to the western conference finals for a third year in a row. ( mark ) after taking a commanding 3 to nothing series lead over the utah jazz, the dubs dominated them last night to seal the deal. they sweep the 4 game series after a 121 to 95 win in game 4. steph curry led the way with 30 points. klay thompson scored 21, kevin durant added 18. and draymond green had a triple double. after the game draymond talked about how the warriors have been able to dominate the competition in the playoffs so far.

( darya ) the marin county coroner accused of sexually assaulting a young girl makes his first court appearance. prosecutors say darrel alan harris started sexually assaulting a girl in 2008 and then assaulted her again when she was older. harris was arrested in eureka

allen and lindsay cutshall were murdered on a beach in jenner in 2004. and now the sonoma county sheriff's office says the killer is in custody. shaun gallon has been named as the main suspect. and this morning we are hearing from jason's parents for the first time. ( mark ) investigators say the killings were random and that gallon had no connection to the couple. gallon was already in police custody when investigators linked him to the murder. he had been arrested in march for the murder of his brother in forestville. ( darya ) the valero oil refinery in benicia is being fined for violating regional air pollution rules following the flaring incident. the bay area air quality management district says it has issued four violations. one for causing a public nuisance and three for releasing excessive smoke. it all started with a power

outage at the refinery on friday morning that led to flaring which released massive plumes of thick, black smoke into the air prompting a shelter in place. there will be continued flaring at the valero refinery this week while crews work to restore operations at the facility. ( darya ) members of the "assyrian church of the east" in san jose say they are scared after someone deliberately started a fire at the church. the fire happened early sunday morning. while there was no threat against the church, federal investigators were called out because the fire was at a place of worship. those who work at this church fear the person who started the fire will return and do more damage.

near a chuck-e-cheese restaurant in concord has been identified as 66-year-old loreto reyes. and this morning we are learning that a person has been arrested for his murder. police say reyes was a transient and his body was found in some bushes on willow pass road near market street on saturday. police have arrested a person on suspicion of murder. the suspect's name has not been released. police have not said how reyes was killed. ( mark ) one person has been arrested in connection to a deadly stabbing in oakland.( mark ) it happened yesterday afternoon on san leandro street.(ááátriggerááá) when police arrived, a man was lying in the road -- dead from stab wounds. police have arrested a suspect but are not releasing the person's name. ( darya ) investigators are trying to figure out what caused a deadly plane crash near lake berryessa . two employees of icon aircraft operated out of vacaville were killed. 55-year-old jon karkow was the pilot and 41-year-old cagri sever was the passenger. the crash

are learning more about the murder of a castro valley woman who was found dead inside her burned out home. the alameda county sheriff's office says this man... luckie dacaney confessed to the brutal murder of andrea st. john police found the 59-year-old's burned body inside her castro valley home back in december. investigators say in addition to confessing to killing andrea saint john, video evidence also helped confirm

dacaney was the killer. ( darya ) dacany is in custody for a sexual assault in san juaquin county. officials say it appears that their was no prior connection between the suspect and the victim. ( mark ) one person is dead and two others injured following a shooting in fairfield. police say they received calls at about 4-30 yesterday morning. when they arrived at the scene on crowley lane... officers found three victims. we know the two victims who survived the shooting remain hospitalized this morning. police have not said if any arrests have been made. ( mark ) three people are missing and one person has died in extreme flooding in upstate new york and canada. public safety officials say it is the heaviest flooding they have seen in fifty years.

( mark ) in just a few hours we will learn the fate of the man accused of killing morgan hill teenager sierra lamar.( darya ) a jury is set to announce their verdict at 9:00 this morning. kron 4's will tran is live outside the court house in san jose this morning with the details. will. ( will ) jurors in the sierra lamar murder trial have reached a verdict, santa clara county superior court officials announced this afternoon. the verdict will be read in court at 9 a.m. on tuesday at san jose's santa clara hall of justice. antolin garcia-torres, 26, pleaded not guilty to the murder of 15-year-old sierra, who has not been seen or heard

from since march 16, 2012, and to the attempted kidnappings of three women in safeway parking lots in 2009. if garcia-torres is found guilty, the jurors will weigh the aggravating and mitigating factors and select between death and life without the possibility of parole. both sides would be allowed to present evidence during this phase of the trial. garcia-torres was arrested on may 21, 2012, two months after sierra went missing and after investigators found his dna on her jeans, which were recovered near where she went missing outside morgan hill. sierra's dna was also found on an interior backseat door handle and on the outside of a pair of work gloves in garcia-torres' 1998 red volkswagen jetta. defense attorneys for garcia-torres have alleged cross- contamination during the evidence collection process, pointing to sloppy techniques by the santa clara county district attorney's crime laboratory.

( anny @ land ) rusty stapp and his family are now suing bart for three million dollars. they were returning from a birthday dinner in san francisco when the mob began pounding on the train as it pulled into the coliseum station. stapp and his family claim bart did nothing to prevent the attack and robbery. they say the person driving the train should have realized people were pounding on the doors and never opened them.

this was the third officer involved shooting in the last week. ( mark ) if you drive in the north bay - you could soon be charged a toll to use highway 37. officials say the highway is prone to flooding and traffic congestion and charging a toll could help fix some of those problems. marin county officials it can take years to get the money to fix the highway and a toll could help speed up the process. but some business owners in the area say a toll will be too costly for them. ( mark ) forty-thousand people use highway 37 every day. it connects solano, marin, napa and sonoma counties. ( darya ) we are learning how much it is going to cost to fix some of the roads damaged during the winter storms. 37-million dollars is needed to fix highway 35 in santa clara county. highway 35 washed out in the santa cruz mountains in february. cal-trans says it will need to build a retaining wall to get the road

repaired and back open. according to caltrans, this road will cost the most to fix than any other road damaged by the winter storms. ( mark ) new this morning... former san francisco 49ers legend joe montana filed a lawsuit against the developers of the millennium tower in san francisco. the luxary high-rise condominium has sunk about 16 inches and is tilting 12 inches since it opened in 2009. montana is accusing "millennium parterns" of hiding the building's troubles when he and his wife bought a unit in 20-13. this is the latest in a string of lawsuits against the tower including giants outfielder hunter pence. ( darya @ land ) a closely watched proposal to eliminate sales taxes on tampons and diapers has failed at the state capitol. under the bill, taxes on hard liquor would have gone up to make up for the lost money. the bill's sponsor says the state should not be taxing necessities for women and children. the bill didn't make it out of a legislative committee yesterday after lawmakers expressed concern over raising taxes. ( darya @ land ) two people in orange county have gotten sick after drinking tea made from deer antler.

( anny @ land ) jason allen and lindsay cutshall were murdered on a beach in jenner in 2004. and now the sonoma county sheriff's office says the killer is in custody. shaun gallon has been named as the main suspect. and this morning we are hearing from jason's parents for the first time. ( anny ) investigators say the killings were random and that gallon had no connection to the couple. gallon was already in police custody when investigators linked him to the murder. he had been arrested in march for the murder of his brother in forestville. ( mark ) the valero oil refinery in benicia is being fined for violating regional air pollution rules following the flaring incident. the

bay area air quality management district says it has issued four violations. one for causing a public nuisance and three for releasing excessive smoke. it all started with a power outage at the refinery on friday morning that led to flaring which released massive plumes of thick, black smoke into the air prompting a shelter in place. there will be continued flaring at the valero refinery this week while crews work to restore operations at the facility. ( mark ) the body found near a chuck-e-cheese restaurant in concord has been identified as 66-year-old loreto reyes. and this morning we are learning that a person has been arrested for his murder. police say reyes was a transient and his body was found in some bushes on willow pass road near market street on saturday. police have arrested a person on suspicion of murder. the suspect's name has not been released. police have not said how reyes was killed. ( darya ) one person has been arrested in connection to a deadly stabbing in oakland. it happened yesterday afternoon on san leandro street.(ááátriggerááá) when police arrived, a man was

lying in the road -- dead from stab wounds. police have arrested a suspect but are not releasing the person's name. ( darya ) investigators are trying to figure out what caused a deadly plane crash near lake berryessa . two employees of icon aircraft operated out of vacaville were killed. 55-year-old jon karkow was the pilot and 41-year-old cagri sever was the passenger. the crash happened just after 9:00 yesterday morning between pleasure cove marina and markley cove resort. here is a map showing the area. the crash site was not accessible by vehicle.. emergency responders got to the area by boat. the f-a-a has taken over the investigation. ( darya ) one person is dead and two others injured following a shooting in fairfield. police say, they received calls at about 4-30 yesterday morning. when they arrived at the scene on crowley lane... officers found three victims. we know the two victims that survived the shooting remain

( darya ) a 68-year-old woman is body-slammed and thrown in a pool as she tries to get a group of kids to turn down the music at a pool party. this was near fort lauderdale, florida over the

weekend. police say she was out walking her dogs when she went to her apartment complex pool to tell the group of kids to quiet down. the 16 year old who lifted the woman up was trying to throw her in the pool but slipped, slamming her against the concrete. he then dragged the woman into the pool. at this... a bear tried to break into a home in connecticut. you can see his paws pressed up against the glass. one woman was baking brownies inside her home when she saw the unwelcome visitor. the bear managed to get onto the deck railing, stand up and peer in. he was even able to open the screen door, but not the glass sliding door. but the bear was persistent.

police went to the house after getting multiple 9-1-1 calls. but the bear had left by the time they got there. ( darya ) a group of ducklings are back with their mother - after they had to be rescued from a storm drain. this happened in nashville, tennessee... a woman heard the ducklings and called firefighters. you can see how firefighters removed the grate, climbed down into the drain and plucked them out one by one. the ducklings were then taken back to their mother.
